Transparency Guidance:
The Solicitors Regulation Authority introduced their transparency rule on 6th December 2018. The main aim of the transparency rule is to ensure that all clients have a clear, broad understanding of the potential costs that will be incurred, the procedures in place to safeguard both yourself as our client and ourselves as a firm, and also the staff at T.S Edwards & Son who are involved in dealing with your case for you.
We aim to be as clear and concise as possible. However due to many factors that can occur during the course of your matter we ask you to always contact us in the first instance so that we will be able to advise you directly on your matter as this transparency information is broad and not case specific to yourself.
T.S. Edwards & Son is governed in England and Wales by the Solicitors Regulation Authority and is a member of The Law Society of England and Wales. All of our Solicitors hold current Practicing certificates which are renewed annually each year with The Law Society. We abide by the Solicitors Regulation Authority set of Accounts rules which ensure that any clients monies are safe guarded and held in accordance the rules and regulations of said account rules.
All of our clients are protected by our Professional Indemnity Insurance policy in event of a compensation claim made due to a mistake in the advice we may provide, any data protection breaches and the insurance is a requirement of the Solicitors Regulation Authority. We also hold public liability and employers liability insurance in the event of any accidents whilst on our premises. Conveyancing can be split into two main different types, Residential Conveyancing and Commercial Conveyancing. Here at T S Edwards & Son we specialise and offer both types of Conveyancing services to our clients.
Each Conveyancing transaction is different but all follow the same process. The Conveyancing process can sometimes be completed as quickly as six weeks whereas other transactions may take in excess of six months. At present and in light of the Covid-19 Pandemic, the national average timescale for a Conveyancing transaction is between six and thirteen weeks. Whichever timescale your Conveyancing transaction falls into, here at T. S. Edwards & Son we aim to complete the process as quickly as possible.
No property is exactly the same and our fees will reflect the individual circumstances of your sale or purchase.
Before accepting any instructions we will issue a specific Terms of Engagement letter (client care) to you. This will set out hourly rates you will pay. An estimate of fees and outlays we will charge for non-contentious transactional work can also be provided to you by email at this time, where giving an estimate is possible.
The property department of T. S. Edwards & Son is accredited by The Law Society’s Conveyancing Quality Scheme (CQS). This scheme provides a recognised quality standard for residential conveyancing practices. Achievement of membership establishes a level of credibility for member firms with stakeholders (regulators, lenders, insurers and consumers).
We are on the panel of all major mortgage lenders and offer a full service on all property matters.
Purchase of Freehold & Leasehold Residential Property:-
Our fees cover all of the work required to complete the purchase of your new home, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property you wish to buy is in Wales.
Key Stages of the Residential Freehold Conveyancing Process on a residential purchase. The precise stages involved vary according to the circumstances but generally include the following:-
- Take your instructions and give you initial advice
- Check finances are in place to fund purchase and contact lender’s solicitors if needed
- Receive and advise on contract documents
- Carry out searches
- Obtain further planning documentation if required
- Make any necessary enquiries of seller’s solicitor
- Give you advice on all documents and information received
- Go through conditions of mortgage offer with you
- Send final contract to you for signature
- Agree completion date (date from which you own the property)
- Exchange contracts and notify you that this has happened
- Arrange for all monies needed to be received from lender and you
- Complete purchase
- Deal with payment of Stamp Duty/Land Tax
- Deal with application for registration at Land Registry

CLIENT CARE COMPLAINTS PROCEDURE
Our aim is to provide the highest standards of client care at all times. The majority of our clients never have a cause for complaint and are very pleased with the service we provide. However, we are not complacent, and would always wish to know if you are unhappy with any aspect of our services.
If you have a Complaint
If you are unhappy about any aspect of the service you have received or about the bill, the first step is to speak to the person who has been dealing with your matter. Most issues can be resolved quickly and amicably at this stage.
If the issue cannot be resolved to your liking or you wish to deal with someone else, please contact Stephen Neale on 01443 814161, or by e-mail at mail@tsedwards.com, or by post to our office address.
What will happen next?
We will send you a letter acknowledging receipt of your complaint within two working days of receiving it, enclosing a copy of this Procedure.
We will investigate your complaint. Stephen Neale will review your file, which might include speaking to any other members of staff who have been involved in your matter.
The investigation might also involve inviting you to a meeting to discuss your complaint. We will do this within 14 days of sending you the acknowledgement letter. Within three days of any meeting, we will write to you to confirm what took place and any solutions that were agreed with you.
If you do not want a meeting or it is not possible, we will send you a detailed written reply to your complaint, including suggestions for resolving the matter within 21 days of sending you the acknowledgement letter.
Appealing the Decision
If you are not satisfied with the outcome of our investigation, you may contact us again, and we will arrange for someone unconnected with the matter to review the decision. We will write to you within 14 days of receiving your request for a review, confirming our final position on your complaint and explaining our reasons.
Timescales
If it is not possible to deal with your complaint in this timeframe, we will inform you of the delay and the reasons. However, we will do our best to resolve the matter as soon as practicable.
Charges
Please be assured that there are no charges for the conduct of a complaints investigation.
Other Options
The Solicitors Regulation Authority can help if you are concerned about our behaviour. This could be for things like dishonesty, taking or losing your money or treating you unfairly because of your age, a disability or other characteristic.

Under our professional regulations, we have eight weeks to consider your complaint. If we have not resolved it within this time, you can ask the Legal Ombudsman to consider the complaint. The Legal Ombudsman is an independent ombudsman scheme that resolves complaints about lawyers. It can be contacted at P O Box 6806, Wolverhampton, WV1 9WJ, or telephone 0300 555 0333, or via enquiries@legalombudsman.org.uk.
The Legal Ombudsman accepts complaints from individuals and small businesses, charities or associations. Normally, you will need to bring a complaint to the Legal Ombudsman within six months of receiving a final written response from us about your complaint. It will not normally consider complaints that are more than six years’ old, or where it is three years since the complainant ought to have been aware of the problem. However, this limit is being introduced gradually, and the matter being complained about must have happened on or after 6 October 2010. If the problem happened earlier than this date, you must not have been aware of it before 6 October 2010.
You also have the right to complain about or challenge the bill by applying for an assessment of the bill under Part III of the Solicitors’ Act 1974, but please note that the Legal Ombudsman may not consider a complaint about the bill if you have applied to the Court for assessment of the bill.

OUR PROBATE FEES
Fixed Fees
We offer a fixed fee of £500 plus VAT at 20% and disbursements to obtain a Grant of Probate or Letters of Administration (where there is no Will) in the case of a simple estate where the work involved is limited to completing, from information that you provide, a short Inheritance Tax Return (IHT205) and a Statement of Truth for Executors, and submitting to the Probate Registry.
This estimate applies where there is a valid Will, it is not contested or does not require additional evidence to prove its validity, or in cases where there is no Will (Intestacy), that you provide us with sufficient information to establish your right to apply to administer the estate, and that there is no Inheritance Tax payable on the estate, and no assets outside the UK.
Disbursements to be paid in addition will include the Probate Registry fee of £155.
Probate and Administration of the Estate
Where we are requested to obtain a Grant of Probate or Letters of Administration and to administer the estate, our work will be charged according to the time spent at an hourly rate of £198 per hour, plus VAT at 20% and disbursements. In addition, a value factor, which will be between 0.5% and 1.5% of the estate assets, will be charged for estates exceeding a gross value of £100,000.
Our fees can vary significantly, depending on the amount of work involved and the complexity of the case. Our fees typically range from between £2,500 to £6,000 plus VAT at 20%. The fees in a particular case will depend on factors such as:
- The number of beneficiaries
- Whether the estate includes land and property
- The number and variety of asset-types, such as bank accounts and/or shareholdings
- The amount of debts or liabilities
Once we have the full information as to the nature of the estate assets and liabilities, we will be able to provide a more detailed estimate of the total likely fees. Typical disbursements on the full administration of an estate would include, (where applicable VAT is included at 20%):
- Probate Registry fees – £155
- Advertisements in the London Gazette and local newspapers – approximately £300
- Land Registry Office Copies – £3
- Bankruptcy Searches – £2
Where we are required to draft an Assent or a Transfer of Property to beneficiaries, we will charge additional fees of between £250 and £400 plus VAT at 20%, together with Land Registry fees upon registration.
The work that we undertake will be carried out by an experienced Probate solicitor, and will involve:
- attending you to obtain information in relation to the estate
- correspondence with asset holders and creditors
- completing the Inheritance Tax Returns
- drafting and submitting the Probate Application leading to the Grant of Representation
- arranging Notices in the local and London press (if necessary)
- collecting in the assets and settling liabilities
- payment of pecuniary legacies
- preparation of the Estate Accounts
- distribution of the estate to the beneficiaries
The timescales for completion of the administration of estates vary, but are typically between three and 12 months.
